By creating an account, accessing, or using ChartAI, you confirm that you are at least 13 years of age (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

ChartAI is an AI-powered data visualization and diagram generation platform. The Service allows users to create charts, diagrams, infographics, and other visual content using artificial intelligence. Features include but are not limited to: AI-generated diagrams, synthetic data generation, white paper creation, and image analysis.

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

The Service operates on a credit-based system. Credits are consumed when generating AI content. Credits are non-refundable except as required by applicable law. Unused credits do not expire. Neural Canvas Inc. reserves the right to modify credit pricing and allocation at any time with reasonable notice.

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload or transmit malware, viruses, or other malicious code
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to generate misleading or fraudulent content
• Share personal identifiable information (PII) of others without consent
• Resell, redistribute, or commercially exploit the Service without authorization

ChartAI does NOT provide financial, investment, legal, medical, or other professional advice. All content generated by the Service is for informational and educational purposes only. You should not rely on any AI-generated content as a substitute for professional advice. Any decisions you make based on content from ChartAI are solely your responsibility.

Our Content: The Service, including its design, features, code, and branding, is owned byNeural Canvas Inc. and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of any content you input into the Service. By using the Service, you grant Neural Canvas Inc. a non-exclusive, worldwide, royalty-free license to process your content solely for the purpose of providing the Service.

Generated Content: Subject to these Terms, you own the rights to the AI-generated outputs created specifically for you through the Service, and may use them for personal or commercial purposes.

Neural Canvas Inc. is committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable data protection laws.

Data We Collect:

• Account information (email, name, profile image from OAuth providers)
• Usage data (messages, generated content, credit transactions)
• Technical data (IP address, browser type, device information)

The Service integrates with third-party providers including but not limited to: Google (authentication), OpenAI (AI processing), Google Gemini (image generation), and Stripe (payment processing). Your use of these integrations is subject to the respective third-party terms and privacy policies. Neural Canvas Inc. is not responsible for the practices of third-party services.

Payments are processed securely through Stripe. All purchases are final and non-refundable, except as required by applicable law or at our sole discretion. If you believe you are entitled to a refund, contact us within 7 days of purchase at support@chartai.io.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEURAL CANVAS INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEURAL CANVAS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Neural Canvas Inc., its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the language shall be English.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
